8. Data Protection
8.1
In order to monitor, check and validate the deliverables outlined in your SV Plan, the Council is required to share information included in your submission which may include personal data.
8.2
It is accepted that all personal data is provided consensually to the Council whose lawful basis for processing is for the performance of a task carried out in the public interest.
8.3
Where the Contractor has selected to provide paid employment opportunities as part of the SV Offer and subsequent SV Plan, this will include the personal data of Staff.
8.4
The personal data of Staff must be consensually provided by each person in the Social Value Monitoring Report and therefore the Contractor shall ensure it satisfies itself in respect of its obligations under the UK GDPR and Data Protection Act 2018. This includes, but not exclusively, relevant privacy notices to Staff.
8.5
Where the Contractor has selected to appoint a sub-contractor in relation to the SV Plan, the Council will be required to share the personal data of the sub-contractor with SIB. However, a sub-contractor can only be appointed with the prior written agreement of the Council/SIB; and subject to the Contractor demonstrating it has met its obligations under the UK GDPR and Data Protection Act 2018.
