36. Serving of Notices

36.1

All notices under this Contract must be in writing and be served by e-mail unless it is not practicable to do so. An email is effective at 9am on the first Working Day after sending unless an error message is received.

36.2

If it is not practicable for a notice to be served by email in accordance with Condition 36.1 , notices can be served by means of personal delivery or first class postal delivery. If either of these options are used to serve a notice, such notices are considered effective on the Working Day of delivery as long as they’re delivered before 5pm on a Working Day. Otherwise, the notice is effective on the next Working Day.

36.3

This Condition does not apply to the service of legal proceedings or any documents in any legal action, arbitration or dispute resolution.
