42. Waiver
42.1
The failure of the Council or the Contractor to exercise any right or remedy shall not constitute a waiver of that right or remedy.
42.2
No waiver shall be effective unless it is communicated to either the Council or the Contractor in writing.
42.3
A waiver of any right or remedy arising from a breach of contract shall not constitute a waiver of any right or remedy arising from any other breach of the Contract.
