4. Contract Price review
4.1
Unless specified otherwise in the Pricing Schedule, the Contract Price shall remain fixed during the first year of the Contract.
4.2
The Contractor shall only be entitled to one Contract Price review for each year of the remainder of the Initial Period and any Subsequent Period arising from the Council having exercised its option to renew the Contract.
4.3
All requests for a Contract Price review must be made in writing by the Contractor and sent to the Contract Manager not less than five (5) months prior to any relevant expiry date under the Contract i.e. Initial Period or Subsequent Periods.
4.4
Any Contract Price increases are capped at the rate of Consumer Price Index ‘CPI’ at the time of the Contract Price review. In exceptional circumstances, where the Contractor can properly demonstrate and evidence increased costs which exceed the rate of CPI, the Council may agree to a Contract Price increase which exceeds the rate of CPI.
4.5
All Contract Price reviews must be accompanied by evidence demonstrating the increase/decrease in costs associated with carrying out the Deliverables. The evidence provided must demonstrate costs which are directly attributable to the provision of the Deliverables.
4.6
If the Contractor does not undertake a Contract Price review in any one year, they have waived the right to the review for that year and this does not entitle the Contractor to request an additional increase in a subsequent year.
4.7
Any Contract Price increase request under this Condition shall not be admissible unless the aforementioned provision is adhered to and unless the Contractor shall within 28 days of being requested to do so, furnish such evidence as the Council shall reasonably require substantiating the claim.
